Privacy Policy for the ACTICO GmbH e-recruiting system

1. Privacy Policy
ACTICO GmbH thanks you for your interest in employment with the company. The ACTICO GmbH website offers you the opportunity to apply for vacancies using our online procedure. Because you have begun an online application, we will process personal data about you that you provide to us electronically for the purposes of your application.
ACTICO GmbH will treat all personal data entered into the website with strict confidentiality according to the valid legal data protection provisions and process it only for the purposes of furthering the application process, filling the position, and completing the hire. At ACTICO GmbH, staffing is performed in cooperation with the responsible personnel department employees, those responsible for the department in question, and company management.

2. Definition of terms
The privacy policy is based on the terminology of the General Data Protection Regulation (GDPR).

- “Controller” is the natural or legal person, public authority, agency, or other body which, alone or jointly with others, determines the purposes and means of processing personal data. Where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its designation can be provided for by Union or Member State law.
- “Processor” is a natural or legal person, public authority, agency, or other body which processes personal data on behalf of the controller.
- “Recipient” is a natural or legal person, public authority, agency, or other body to which the personal data are disclosed, whether or not it is a third party. However, public authorities which may receive personal data within the framework of a particular inquiry in accordance with Union or Member State law shall not be regarded as recipients.
- “Third party” is a natural or legal person, public authority, agency, or body other than the data subject, controller, processor, or persons who, under the direct authority of the controller or processor, are authorized to process personal data.
- “Consent” means any freely given, specific, informed, and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

3. Collection and processing of personal data

Applying for a vacant position at ACTICO GmbH in the e-recruiting system requires the mandatory entry of certain personal data (such as first and last name, postal address, and e-mail address). You have the option of voluntarily providing contact information in addition to the mandatory fields that might make it easier for us to contact you (such as your telephone number). In order to process your application in as targeted a manner as possible and take your desires into account, we have provided the option of voluntarily providing additional information, such as information about your career and files for a personal cover letter, certifications, your resume, etc. By transferring your information, you are consenting to ACTICO GmbH’s processing and use of that information in accordance with legal data protection provisions and this privacy policy.

4. Legal basis for data collection
The legal basis for the processing of your personal data in this application procedure is primarily § 26 BDSG-neu (the new German Federal Data Protection Act). Pursuant to this act, processing of data that is required in the context of a decision about the establishment of an employment relationship is permissible.

If the data is required after the conclusion of the application procedure in the course of legal prosecution, it may be processed on the basis of the conditions laid out in Art. 6 GDPR, especially in the pursuit of legitimate interests in accordance with Art 6 No. 1 letter f) GDPR. In such as case, our interest is the establishment or defense of legal claims.

5. Data storage, use, and erasure
If your application is successful, the data and files you provide can be further processed for the purposes of employment. If your application for a vacant position is unsuccessful, ACTICO GmbH will store the data and files provided for no longer than six months. After the six months have expired, the data and files are deleted. The application can be retracted at any time. Retracting your application leads to the deletion without undue delay of your data and files in the e-recruiting system with the restrictions listed below. Within the framework of an online application, you can also demand that individual files or pieces of data be deleted. However, ACTICO GmbH reserves the right to store a limited amount of your data for six months in order to comply with legal provisions, specifically German General Equal Treatment Act (Allgemeines Gleichbehandlungsgesetz, or AGG) documentation obligations.

6. Transfer of data to third parties
The data you enter in the form and the electronic files you attach will be treated confidentially and transferred to third parties (such as service providers) only in a protected form and only if they are involved in the local staffing process and the confidential and secure processing of your data is guaranteed in accordance with applicable data protection regulations and the relevant legal requirements are contractually regulated. Your personal data will be transferred to third parties (authorities, public bodies, etc.) outside of the application process only on the basis of mandatory, specific legal requirements.

7. Rights of the data subjects
You have the right to access the personal data concerning you that we process.
If your access request is not in writing, we may require that you provide evidence that you are the person you claim to be.
You also have the right to rectification, erasure, or restriction of processing if you are so legally entitled.
You also have the right to object to processing within the framework of legal requirements. The same is true of the right to data portability.

8. Revocation
Some data processing activities are possible only with your express consent. You have the option of revoking, at any time, consent that has already been granted. An informal email to the responsible personnel department (jobs@actico.com) is sufficient. The lawfulness of data processing that has occurred until the revocation remains unaffected by the revocation.

10. Security
Due to technical and organizational security measures (Article 32 GDPR), ACTICO GmbH, according to the current state of the art, ensures that your personal data is protected against unauthorized data intervention such as data loss, destruction, intentional
manipulation, or access by unauthorized third parties. In particular, transfer in conjunction with the processing of data and files done in encrypted form (HTTPS encryption).
